Who Files a Criminal Charge in Indiana?

The victims of criminal acts, such as domestic battery, sometimes threaten their abuser with filing criminal charges.  This is not possible in Indiana.  Instead, a victim only has the power to file a police report; thereafter, it is up to the prosecutor’s office as to whether criminal charges can be filed.

Victims Cannot Get a Case Dismissed

Just like victims cannot bring criminal charges, they also cannot dismiss charges.  The prosecutors may be more likely to dismiss a case, however, upon learning that a victim’s testimony may not be as strong as initially believed.
